A rural property of almost 34 acres, around 800 thousand m2 in the interior of São Paulo, is being sold at auction until July 5th, to compensate investors who were deceived and bought plots of land, which were never delivered. The information is from Market Monitor .
reproductionFazenda São José do Ribeirão is owned by Loteadora Agropecuária Santa Luzia, which, in 2008, began selling more than 200 lots in the city of Itupeva (SP) without Portugal Mobile Number List them being registered with the property registry. The owner sold the land with the promise that the place would have a value compatible with other condominiums.
The investors went to court with a declaratory action for the nullity of the purchase and sale, requesting loss of profits due to frustration of the promised increase in land value.
According to lawyer Héctor Borecki Carrillo , partner at Carrillo Advogados, who represented part of the investors, during the sales, the owner had also promised that she would deliver the lots with concierge, water, electricity, paving and 24-hour security, which would generate the natural appreciation of lots, which attracted new customers.
"The promises attracted dozens of buyers, who paid in a single installment to purchase part of the 214 lots," said the lawyer.
The company Loteadora Agropecuária Santa Luzia recognized the sale of land in an unregistered subdivision, justifying the illegality as a result of the death of one of its partners.
After years of legal proceedings, the São Paulo Court of Justice ordered the auction of the property to compensate consumers who suffered losses.
The area is being auctioned with a starting bid of R$12.89 million. The auction started on June 11th and should run until July 5th, 2021.
